Your car will be plugged in at the VPC in NJ (or wherever your cars arrives stateside) and the folks there are pretty well informed individuals , the chance they will pull codes / info is very high (for example they'd easily detect if you unplugged the exhaust valve connector on the E9x etc)
I am pretty sure you don't want to be in a situation where your car is being held at the VPC and you have to explain to BMW NA how the tune made it on your car (or any other non OEM parts such as exhaust/downpipes etc)
From a legal perspective you also sign papers at pick up that you won't perform any modifications etc
