Sadly thinking about enforcing NC LEMON LAW on my M5 but am I there yet ?
Sadly car is squeaking again after they changed the front right wheel bearing and was taken care of for a few days of driving and now same story again and I don't even track my cars or drive them that hard!!
So going tomorrow to drop it off for second time for this matter and prior to that it took them 2 visits to fix the LCD screen first changed the head unit and then asked me to come back when it didn't solve the problem of flickering screen and they had to replace the LCD which took care of the issue. Tomorrow I will have visited the dealership for 4th time BUT FOR 2 SEPARATE issues and not for more than 20 days? I live this car and I don't want to part with it but this has been a headache with my schedule? Car has 8500 mikes in it and had it for 6 months What do you think guys? Especially that if I get what I want I don't know what the deal will be for another one?

Just did a google search of North Carolina lemon law and you may be a bit premature.
In the first 24 months or 24,000 miles, presenting your car for the same defect four times with unsuccessful repair or having to leave the vehicle with the dealer for 20 business days may trigger a lemon law claim. But it may be time to start a discussion with the dealership about what it would take to get a replacement for your vehicle if the problems persist. Dave |

Mostly get a 335i that's under 1500mi.

Make sure you fully understand the lemon laws in your state prior to bringing this up with your dealership. Since you have already driven 8,500 miles there will most likely be a reduction in value for you "use" of the car.
It is not an easy process to go through and it isn't as simple as just handing the keys back and getting a new car. If at all possible, keep working with the dealership to resolve the problems. Especially since you haven't hit the requirements to lemon a car in your state.

You will be very lucky to get a replacement car or your money back primarily due to squeaking brakes. The M5 has a high performance floating rotor brake system which is known to be 'noisy'. It one of the issues one has to live with when purchasing a high performance car with decent brakes occasionally. I hope you've tried the various methods to mitigate the squeal before you attempt to head down this route.

This car has a ridiculous amount of brake squeal. This is not a corvette or a gt3 rs, its "luxury" super sedan. It should not start squeaking from 30 mph to 0, which sometimes equates to several seconds in traffic.

Almost everybody has experienced or will experience this squeaky noise related to brakes. there are so many threads here about this issue and there are different ideas and solutions like bed-in process, cleaning with spray, applying hard brakes in daily/weekly basis or ... some people say causes because of feathering the brakes. some people relate it to the heavy weight of car. Service guys simply say this is normal for high performance cars!
My experience was to have dealer fixed it. they changed the rotors and ordered special pads recommended by BMW NA. Their actions solved the problem temporarily and then it came back. 20 years ago I started down the NC lemon law path for a Ford Thunderbird with numerous issues. My lawyer explained it really needs to be a safety or reliability concern to use the law successfully. Not just squeaks or a minor annoyance. I did send the letter of intent giving the dealer a last opportunity to fix. It did raise their efforts and resolve the issues. But I was without the car for a month. I just traded for a different brand and took a loss.

My M5 with CCB gets the squeaks in light rain & my 996 Turbo, 997 turbo S and Cayenne Turbo had the squeaks 30% of the time. Its part of high performance bakes... Something you have to deal with when you buy these cars.... They do get better with new pads and rotors but thats only a temp fix, the sound will return at some point.

BMW does not let things get to the whole lemon process. A lot of times returns or replacements end up taking place for reasons that dont come close to safety. Electrical issues for example in headlights or navigation can require your car to be torn apart and sit in the service for days and usually repairs involve extensive and invasive changes. And they can never put your car together as if it were new from the factory.
BMW knows that if they dont accommodate people, their brand will be hurt and in cars that is as rare and exclusive as M5 and M6, they cannot afford to upset people. When your 328 customer complains about squeaky brakes its one thing when the guy who owns a 135k car with individual leather complains its another. |
