Hi everyone,

I emailed the entire BMW NA crew last night informing them I was concerned they did not get back to me on the date they promised last night. Another day has come and gone with no email of phone call. I'll call them tomorrow, but is this normal? As I suspected I had this feeling they'd drag their feet now that they refused to re-take possession of the vehicle for repair.

So disappointed

This situation sucks and itīs very disappointing that BMW NA is dragging their feet; in the end I hope they do the right thing here.

Have you spoken to an attorney? Sometimes a simple letter will get them to stop dragging their feet and put a solution on the table; some leverage can't hurt.

Remember, days in shop vs. days in possession is a key factor in proving your vehicle is a lemon (not inclusive of the time & attempts the manufacturer takes to repair).

So factors are:
1. time in possession;
2. attempts to remedy error/breach of warranty;
3. time associated with remedial work with said alleged error/breach above; and,
4. negligence in communicative efforts, transparency, and undisclosed latent defects, and patent defects ("Bad Faith" in "Fair Dealing").

They're building their case perhaps (lowering the 65% time in shop factor)?

Seriously, it is highly advisable to engage a lawyer if you do not receive a response by 1/6/17. In your engagement letter, limit the lawyer's scope of work to only writing a correspondence to BMW NA & Dealer collectively. This will effectively save you some money -- rather than hourly, full blown representation.

That is if you want to give BMW NA a "nudge" as suggested above.

Thanks. With the rash of dealer break ins in the area and the fact they did not want to tie up a loaner vehicle they flat out refused to take my vehicle on 12/27 when I returned with the vehicle. I left a message with Veronica this morning.

Anyone on this forum who is an attorney and have specialty in this area. Happy to pay for their services?

A letter from an attorney on your behalf may run you $1-1.5k, from my past experiences with building leases, not car related.

Hi everyone,

Chiming in with an update. After a number of reminders to BMW NA regarding the dates they committed to providing me an update, I heard back last Friday that on Monday they'd call me with a date to bring my vehicle in. That day was Tuesday and the local field tech reviewed the vehicle Wed. They had the shop foreman ohm out an number of wiring harnesses today. Those came back clean. The recommendation now is to replace the Integrated Control Module (ICM).

The ICM model takes 7-10 days to come from Germany as they don't stock them in the US. Based on my research it appears the ICM is the central gateway that includes the systems that are malfunctioning. I guess, I'll have to wait and see.

Well, just to give everyone an update. So it's been 10 days since my last update. We are still waiting on the ICM module, but in the meanwhile the local BMW Field Tech has recommended we replace the ZGM module and the wiring going from the SLZ to the ZGM module. These were replaced, but did not fix the problem. Hopefully the ICM arrives tomorrow, get's installed, program and tested for Wed or Thursday.

We now have officially crossed the 2 month mark of BMW trying to resolve this issue. In the 17 week's I've owned the car, it has been in BMW's possession for 10 weeks (60%).

Some of my car friends have recommended that I take it to another dealership, but I don't believe that will help as the current service department is now just taking direction directly from BMW NA in Jersey through PUMA. Responses from BMW through PUMA seem to be getting longer and longer as I believe they've exhausted ideas.

I could understand if I owned some lower end 320i, etc. For God sakes, I have an M5, you would think they'd go a bit above and beyond. I can't believe one of the companies I admired most has disappointed me so much.

It ended up being the Dinan piggyback. Although CAN signals are a straight pass-through, the harness weakens the signal enough that when it's cold out the resistance is beyond the tolerated limit. The dealership installed a new harness and piggyback unit, but it didn't help. There is no known fix.

Dinan was happy to pickup the cost from BMW and offered to provide me with a full refund on the piggyback system at anytime if the malfunction annoys me enough.

BTW, Dinan acknowledge they have had this problem with other //M's & 650s.
So be aware, if you are looking at going with a Dinan Piggyback and are in a region where it gets cold you could potential run into this issue.
