I recommend you talk to a lawyer. After some legal advice, BMW dealership and BMW NA are responding to what I have to say. You have options.

I'd disagree with one. I know plenty of people who mod their cars and take even more delicate care of warm up procedures, changing fluids and belts, etc. where as I've seen "stock" low mile cars with 5-10+ years of neglect in the fluid/ warm up procedure department.

My point is I don't trust mods. Why buy a car which has more power train wear than one which has less.

If you have the time ask your lawyer to write a demand letter and file law suit . you may have better luck using a lemon law specialist but be prepared for an uphill fight , it may take 6-10 months before it is settled .
if you dont have the time all you can do is spend the money and hope for the best .
Best of luck . i don't understand how they can just deny warranty if the car was never modified or red flagged .

Call BMW NA as well, and tell them of your intentions. It will take few day to reply, but they will reply for sure.

Already tried that and got shot down. Motor just got yanked out today and is going to be getting some new goodies.
