Advice needed

Hey guys, I am hoping I can get an informative advice from all of you. I bought a car on Ebay that was described to be in good condition. The car showed up and it needs major mechanical work and also has some exterior damage. Seller did not list any of it in the add and to make things worse I am in CA and they are in FL. Lesson learned big time and next time I will pay an independent shop to go out and inspect the entire car, but the seller was a reputable Porsche/BMW shop and had excellent reviews.
Long story short, they are not willing to partake in any of this and Ebay protection is not working because the car is more than 10 years old.
What would you guys suggest or what do you have experience with?

In my experience in Selling Tires,parts etc on Ebay,
as a Seller, I carefully take pictures of the item if there is any damages that was on the item and it was NOT on My Picture listed on Buy It Now, you can fight that, seller is required to take pictures of EVERY noticeable damage,cosmetic issues and anything that can make a Sell go smooth I would be taking pictures of everything. also if Seller did not note that it needed some major repairs or did not take any pictures of what you described damages you can make a case I would Hope so. if you can go back on that Ebay transaction and Ebay listing of the car you just bought i would print them out and review the details that the seller described. And if there is any misinterpretation I would hope also you can fight that.

Yea, you sound like a person of character, which is obviously what this seller is lacking. I tried to reach out to Ebay, but since the car is more than 10 years old there is nothing they can do for me. I was thinking of going the legal route, but not sure how to proceed being that the seller is in FL and I am in CA.

Why would the age of the car matter? You are not looking for any type of warranty on the car - you re looking for recourse against a seller that delivered a product different from what was described in the auction. The age of the item should be irrelevant. I can understand age being an issue if the car was running well and broke down 3 weeks later but here it is a simple case of fraud.

I agree - Age of the car is irrelevant. Just in my experience, it is required of the seller to list all issues/damages/condition of the car. If what you got is not described as listed, then you should be covered under their buyer protection.

Did you check with Paypal? Should be able to go through their buyer protection if you used them to pay the transaction.

Initial deposit of $500 went through Paypal and the rest of it was a wire.
What I am shocked with is how Ebay allows this form of action. They collected their fee and washed their hands off. In so many ways this sounds like Ebay is supporting and financing criminal activity. I spent couple hours with them on the phone and there is not a single repercussion to the seller. They keep on insisting for me to work with the seller after I informed them multiple times that seller refused to work with me in writing.
If I do file a suit it needs to happen in the state of FL which is across the whole country.
Both of you are right, the age of the car should not matter. A fraud could be committed on a 1 yr old car and 100 yr old car.

If no1 listens to you, advise goimg legal route


Or for a few thousands. I can have Vinny,Vito and Sal go to his house with a carpet and baseball bat. Lol

Any chance you can show us the eBay listing and some pics of what you noticed after delivery?

I thought eBay/PayPal automatically hold funds until the buyer receives product and is satisfied?

Wire transfers are risky in general.
