I would like to give them the opportunity to rectify the situation in an equitable manner. however if not resolve by end of week maybe I go to yelp.

Spoke with BMWNA. long story short, they tried to get an update from the service director who was unavailable and they said they couldn't do much until the dealership had their own resolution.

Just spoke with service director and we agreed on terms.

Alignment + 50% off the other two tires.

Some people might not agree. But I feel this is a fair and equitable resolution.

Seems like a fair deal.

With 13K miles on the old tires - paying for only one out four tires plus no charge on the alignment you may have come out ahead

absent any tangible evidence, i have to take their word for what happened.

my guess the truth lies somewhere in the middle. careless guys in the car wash with the music/bass too loud not paying attention when positioning the vehicle.

on the other hand, maybe it was a launch controlled joyride which resulted in a serious pothole impact.... or just as likely, they are telling the truth that the carwash inadvertently pierced the tires... who knows.

at least they rose to the occasion on a fair settlement for the other two tires and i'll have an alignment done which should show any major deviations from normal.

I think if you're satisfied, then leave it be. You can always look for signs of obvious abuse, like rims, spoiler, door skirts, etc... I would not want this keeping me up at night though, so if there's any question in your mind I would bring it up now. 3 miles seems like a legit test ride and although you can do damage in 10ft, it's not like a 25 mile joy ride. i.e.- Ferris Bueller... For those of you old enough to remember.
