Along the same lines...it is better that it is an axle rather than the M differential... given how BMW NA isn't paying for the repair.

Don't let them throw you around like that. They look for the smallest unrelated item to blame it on. Northern X5M would have broken his axle long time ago. Doing launches on a sticky track with sticky tires puts a lot more stress on these things than lowering springs.
Take it up the ladder, but I would remove the tune if I were you before you take it back in.

i thought the comp pkg drops the car similar to the H&R springs? how can they justify that the springs called the axle failure?

dirty move on BMW's part.

With a price of around $ 1500,- it's probably either of the driveshafts.

Part # 33212284115 or 33212284116

The OP mentions a tune, that would be a "better" reason for BMW to void the warranty.

I would be surprised if the car and the warramnty request were not already in the system. BMW must have means to prevent forum shopping.

Unreal ........if these axles are this sub-standard, why in the hell does BMW program launch control into these cars? So I'm guessing that they'll cover a LC failure but not a quick shift. I doubt the OP's tune stressed the axle going from 1st to 2nd anymore than a full LC dump.......incredible.............Phil
