A brief update - today I had my car towed from Chapporone's to Phil Thearle's Autowerks Collision Center in Santee. I spoke with Phil and he sounds like he understands my situation is pretty difficult and I'm going to be responsible for a lot of this repair out of pocket, almost the point of being a customer pay without any insurance. He really wants me to come out and see their facility and wants me involved with the repair process to see what needs to be done and how. I liked our conversation and I think I understand why he has such a good reputation. They will be providing me an estimate for the repairs in a few days. The time of the year is difficult since everyone is on vacation or doing half-days. Getting into an accident on Christmas was terrible timing..

Yeah, get yourself full coverage. And stay out of Mexico. Planning to head up to Phil's on Monday and make sure these repairs get started as soon as they can.

They won't drop you for that, be serious. I leased a new M6 cabrio back in 2009 and about a year later was sideswiped by a city bus. The windshield fell off the bus. It did $25-30k damage to my car and I didn't have it for almost 3 months. Three or four months later I was being inattentive (texting on my phone) and just barely bumped a car in front of me stopped at a light. No damage to their car but $2,500 or so to mine. Two months after that...I was going 35-40 MPH downtown and the city didn't put any warning that they had stripped the cement from an intersection and a manhole was sitting 6 inches above the rest of the road. It gouged the entire bottom of my car and they literally had to replace everything on the bottom of my car from front to back. It was another $20k in damage. This was all within 6 months. They didn't drop me. Needless to say, my insurance went from about $200 to $450/month. All of that dropped off after 35 months even though they keep it on my record for 5 years. I pay about $125/month now for insurance.

Story Credibility

In your first post you say "I couldn't see the damage until after the other car was moved" and then a post or 2 later you say "My car was on the downward-side of a steep slope (gated entrance, not a public road) and started rolling downhill. I couldn't get to my brake in time. I hit a low wall/high bump. There is no other party involved and no police report."

You have a lot of people feeling for you, your car and your troubles but perhaps a little honesty or clarity might be helpful. Just a thought. You hit a wall or a car?

Actually, now that I look, the $125 was for my CLS I just turned in.....the M6 still is only $140-145 (and that is with a sparking clean record now and many discounts).

Jeez. I'll be paying the same as you for an M5. I thought insurance was supposed to get cheaper as you get older. Do you have tickets?

My dad pays less than $250 per 6 months.

I'm in Irvine too, pay about $158/mo. I don't get the lowest insurance though, the cheapest policy may drop it $20/30 month. I also have no tickets. I think they got us because we live in California and Irvine.

Someone in the accounting room probably considered the number of luxury cars located where we live that would increase the risk for higher amounts of damage due to car accidents.

To the original poster.... i hate to be the one to tell you this but after you do all the repairs your beastly M5 will have lost between 20-30% of its current market value. Thats over and above the usual inflation. The point being that your damages to the car will devalue its market value and said damages even tho repaired would have to be disclosed to any subsequent buyer. so if you are buying this M5 rather than a lessee, my advise would be to sell the M5 after you get the repairs done while your car is at its highest market value. take the loss now on the diminution in value with the least amount of inflation hit. Take the money and buy another M5. If you plan on keeping the car and not selling it any time in the next several years than disregard everything im telling you..... I deal with car damage law suits on a daily basis and diminution in value after property damage to your car can be substantial when you try to sell it later on. the next buyer will have leverage over you in the negotiation process due to the diminution in value.

He claims it's a lease so when he returns it, the leasing company will take the hit. The advantage of leasing I guess, as long as the repairs are done to factory standards they will take the hit on diminished value. From the sounds of it, he's not looking to report it to anyone to avoid the insurance company from finding out. So it will not show up on CarFax or dmv records. I wonder what the leasing company can do if they find out, can they go after the owner?

It depends on the leasing company....id have to go back to my lease agreement docs to see if that issue is addressed. The problem is at some point in time after the leased M5 is returned the car will undoubtedly go to auction and picked up by another dealer to sell off their lot....if the damage was never reported or shown up on Carfax or the dmv the eventual car buyer down the line will be unknowingly negotiating on a previously damaged vehicle that has a diminished value.....if the dealer didnt know or should have known they would be off the hook in terms of liability of any fraud allegations....as to the OP the question becomes one of ..."do i disclose it?" Thats a question only he can answer

There is nothing the leasing company can do as long as it is brought back to proper condition.

It will be very easy to see the vehicle has been repainted during an inspection so the leasing company will not miss it when turned in.

Depends I guess. I know that on close inspection with a special light and paint gauge meter you can tell, but when I returned a leased vehicle years ago, the salesman merely walked around the car, started it, ran it by carfax, and made me sign. This was back when I owned an Infiniti. With my M5, I had my door repainted to properly fix a door ding and it cost me an extra $250 for a pro detailer to polish and blend the paint to match adjacent panels. No matter how good the paint operator, a human can never match the computer controlled robots and controlled environment of the factory. This is why blending has to be done to adjacent panel. OP, pay attention to the Orange peeling on the paint. They will try to come close with wet sanding and polishing, but it will not match the factory's consistency. Body shops aren't detailers, you will want to take it to one after to do the finishing touches. You can get it 90-95% close to the factory paint, but to a trained eye, it's easy to tell.
