krisp, I feel your pain. I know the owner of Carlsen Audi, and can refer him to your RS7 purchase.

Before you get rid of the car, we should at least do one mini Taiwanese M5 meeting.

What hell are you talking about?

I just don't want this particular damaged car. I want BMW to replace with identical car if not then give me my money back.

How is this buyer remorse?

I will still buy the Audi. I may not get anywhere with lawsuit. But I am more than happy to drive the M5 and make it a moving sign at every single BMW dealership.

It's not about the money. It's about principle " BMW should not lie to their customers and expect no consequence."

I don't care about losing money. This has reached grudge level now for me.

Apologies. I thought you just said you were going to buy an RS7.

I get that you want BMW to buy you a new car. Unfortunately, that ain't gonna happen. They damaged your bumper...they should fix it. Move on. Damage during transit sounds fairly common. BTW - you really should accept some financial compensation from BMW for the damage and oil pump.

Anyway, good luck and sorry for your troubles with the car.

For Taiwanese it's very bad luck to buy a wrecked new car. I was willing to overlook everything. But this particular car has brought me too much headache.

Rob- No worry. I apologize too.

1. I never asked for any compensation from day one. I understand car gets damaged and even oil pump recall i understand. The financial compensation does really nothing for me. Couple grand is just another bag for the wife. Its not going to change anything.

2. I am going to get a RS7 for two reason- A. I can't get a RS6. B. BMW really really pissed me off this time around. I don't need the money from the M5 to get RS7.

3. I just really don't appreciate being lied to. The ED specialist Simone even went as far as accusing my dealer on the damage. I had to send her a pict to shut her up. That is not right. Weatherford has been nothing but helpful to me. They went way above and beyond to help me. I have nothing but high praise for them.

But every time i called BMW NA- its always- its a dealership problem, do you want to open a complaint against them. No one from BMW was taking responsibility.

Even as of this morning- When I called Melissa (finally answered), she still tried to spun the issue back to me. She claimed I told her that i had an appointment on 12/7 and she thought issue was taken care of. Little did she know, I recorded our previous conversation. The only 12/7 was mentioned is that i asked to have it fixed by that time frame.

I know no one wants to lose their job and will try to lie to cover their rear end. But once you start to lie, you have to tell even a bigger lie to cover the first lie. At the end, BMW just created a bigger mess that they can't get out of.

This thing can be handled much more smoothly from day one-

1. BMW could just apologize to me for damaging my car at VDC- instead they tried to ping that on the dealer.

2. BMW could just find a body shop close to my house on 11/13 and get my car fixed in a timely manner- instead BMW did nothing. My salesman at weatherford actually did all of the leg work and got BMW mountain view to repair my car (BMW MV dragged their feet- haven't heard from them since 11/26).

Never for once I asked for any compensation (until yesterday- when BMW ignored this issue way too long).

Is it so hard to tell the truth and apologize???? I really don't get it. I really think BMW just thought i am a pushover and not ask for compensation like many others have done earlier. BMW can just wait and let the issue evaporate. Unfortunately, that made me boil over.

I am really getting to a point that I am going to start releasing all of the voice recording and emails from BMW.

After getting hold of Melissa, she promised that she will call me back again by EOD today with some concrete info and proposal. Like previous occasion, absolutely nothing.

I don't understand how long would it take to call a body shop and get a date. Does it take 8 hours to do that? Calling BMWNA is no help. Because the columbus rep needs to follow the executive rep in NJ. I can't get pass Melissa in NJ.

This is getting ridiculous.

Not a lawyer, but married to one... if you are going to record, tell them. I might even inspire them to have more integrity. But I believe recording someone over the phone without their knowledge would be inadmissable for any legal action at best, and could get you a spot of trouble at worst.

The case is already at executive office. Melissa is from that office.

I just found out that they have an employee events today. In other words, Melissa had no intention to ever call me back. She is fully aware of the company events.

I just send email to her manager Fran Kirnum. Hopefully she will get back to me on Monday.

I am very upset when I found out that Melissa had no intention what so ever to resolve this matter.

I once had an issue like this with a Lexus employee. I wrote a letter complaining about her conduct and not seeking any compensation other than that they don't put other customers through the same experience. Lexus fired that woman.

They were very classy about it. Another rep called me back to resolve the issue a week later. When I asked about the first woman, the guy simply said "She is no longer with the company".

The legal requirements regarding recording a phone call vary by state. Some states only require that one party knows that the conversation is being recorded. Other states require both parties to consent. The state with jurisdiction is where the recording device is located.

The legal requirements are not really of importance because he is not using them in court, he may release these recordings to shame BMW. They will not take legal action against him because from a PR perspective that would be even worse for BMW.

This is in the vein of the hundreds of customer service recordings on you-tube relating to Comcast, AT&T, AOL, etc.

I can see the principle behind having Bmw resolve this it just seems alittle excessive to want to get rid of the car cause of a damaged rear bumper insert. Its a $200 part and even with paint wouldn't cost more than $500. Thats not enough money to cost you this much time and grief.

I would have fixed it on my own and send the bill to BMW for reimbursement.

As for the damage itself I am still somewhat puzzled as any BMW dealer in the world (even the worst kind) should have absolutely no problem having the damage repaired. All they have to do is have it fixed at their or some other body shop and work with BMW NA Service rep. This happening all the time in hundreds of instances.
Not sure why your dealer has not stepped up to the plate and just get the damaged diffuser fixed (after all it's only a 120$ part & paint).
