The rule has always been so.
Hamilton lost a race at Spa for overtaking off track...even though he gave the place back...because it was decreed that he had gained a lasting advantage.
Same Verstappen at Austin when he overtook Kimi...he got a time penalty.
I do agreed that Race Control made a bit of a dogs dinner of turn 4 track limits during the race. But after Horners radio call to Verstappen about it, Hamilton was told by Race Control to stop doing it and he did.
What more was he supposed to do?
Track limits and overtaking off track are separate issues.
