Damage done while at dealer
Featured on BIMMERPOST.com They say they are collecting the drivers insurance details. Is the dealership also partially responsible since they are in custody of my vehicle? Should i demand a loaner from dealership while my car is being fixed? They are recommending i get the car fixed elsewhere, is this typical? anything else i am missing here? please help! |

That's rediculous!
1. demand loaner 2. refuse getting it fix elsewhere avoid warranty issue, ask them to return your vehicle as it was handed to them 3. doubt a customer backed into your car, my last visit to the service center, my car almost rolled into the wall as the technician didn't know how to use the DCT and P brake! |

If a customer rather than an employee backed into your car, it will be that customer's insurance that will be responsible, and then yours if that person is uninsured. I'm not an expert here but I don't think the dealership is responsible for damage while they have the car if they're not the cause of it. If a dealership employee backed into your car, it would be the dealership's insurance that would cover it.
I don't think it's unusual for a dealer to recommend you get those types of issues repaired elsewhere. They're service stations, not body shops. If you said you wanted "them" to do it, they'd just take it to a body shop they partner with. Just find a reputable body/paint shop. If it were me I'd actually WANT to take it to a shop of my choosing even if they offered to fix it. I don't think they owe you a loaner if it was a random customer that caused the issue, and especially if you'll be getting it fixed at another shop. You may be able to get the customer's insurance (or your own) to cover the cost of a rental though. Sorry for the damage though! The first day I drove my first car to work, the person in the adjacent parking spot put a huge scrape in my right rear door and quarter panel. She did leave a note though, so that was nice. And then when I had 800 miles on my M3 I accidentally scraped a Suburban's bumper which put a huge scratch in my own rear bumper, which I paid out of pocket to fix. The Suburban was fine since it had an unpainted bumper not attached to the body. EDIT: To the above post about body shop repairs elsewhere posing warranty issues, to deny a future warranty claim they'd have to be able to show that the failure could've been caused by poor workmanship on this repair, which I just don't see being possible on the types of repairs involved with backing into a car.

My guess is your dealer doesn't have a factory authorized repair/body work facility. If they did, then they would offer to take care of the whole thing and handle the claim from the other customer's insurance.
I remember someone once hit my Lexus. The person who hit me notified their insurance company. Their insurance company called and said I should give their info to the bodyshop. I gave the insurance info to the Lexus bodyshop and they handled everything including the claim. My insurance company was not even involved.

thanks for the replies...
dealer collected the insurance & DL info of the offending driver (lady in X5) . so i'll follow up with them and Farmers and see how it goes.... dealer said no loaner from BMW b/c was due to customer not employee. no body shop on the premises, thus the referral. based on limited research the body shop looks legit (metropolitan collision in the heights). accident was at Advantage in midtown. (it's gonna be a heavy coffee day!) |

Ugh, just sucks. Sorry to hear about it. Hope it's just a bumper?
BMW will outsource body work to local repair shops. I would call around and get some referrals to validate their recommendation. |

my agent just mentioned something about filling a "Diminished Value" claim with the other insurance carrier to cover loss of value of car due to tarnished VIN/Carfax report.
anyone know anything about these types of claims? car was purchased not leased. thanks. |

^ Unlikely you'd get a diminished value claim out of that -- but also unlikely that you'd have any diminished value at all. Unfortunate though the damage is, it looks pretty minor, and in fact judging by some of those pics, you may get a bumper replacement rather than repair, which I'd personally prefer anyway.

So apparently the car is too new and it's not in the body shop's system.
They're checking with dealer tomorrow. New bumper, light and quarter panel (maybe). So far.... Hopefully that's it. |

So very sorry to hear this. This Sucks. The fact that they will not give you a Loaner Car is absolutely SHOCKING to say the very least. I would speak to the GM and Demand a loaner. I would not leave without a BMW. Zero chance I would leave without a BMW. Zero. I would threaten everything in the book form Yelp reviews and BMW Board bashing etc. You spent well over a $100k dollars and your car was hit while it was on their property in their possession. They have to take some responsibility. They have many cameras and I would ask to see them as well. You deserve better treatment. I hope you get it.

Minor - very minor... $900 or so gets you a new front bumper cover, get it painted to match (off car) and then take the car in when the part is ready - that way you don't have to leave your car anywhere (swapping probably take a couple hours at most).
