What are the chances that BMW will drag out delivery of ED cars to reduce the chance of Lemon laws kicking in?

I spoke to my SA from the dealer today and he said that those M5s afffected by oil pump may not be immediately delivered to the dealers after clearing the customs.
He mentioned BMW plans on changing the pumps before actually sending the cars out to the dealers. Although it's a short distance to unload and load cars, I guess BMW doesn't want to be liable for blown up engines. *sigh* We get screwed with the adjustable seats, faulty oil pump and now this delay... I hope BMW NA does the right thing and makes up to all of us somehow. |

Ok, who here wants to have their car repaired first at the VDC, I say it should be in order of drop off Given that they say ED cars can take up to six weeks to deliver, they can possibly sit on (read quarantine) these ED cars for awhile even if they arrive sooner without being (legally?) responsible for this time being counted as lemon law time or for loaners.

I asked about the repair and she said that they confirmed with BMW that the first set of replacement oil pumps would go to the plant in SC and that they would get my car in immediately to have the fix done and be ready to go. I asked about the other items (like the seats), but since I didn't know first hand what else was missing on my car, she said that I should call my CA once I get scheduled for pickup so they could go over the car again in detail. It looks like the Toronto is ahead of schedule by a day or so, so depending on customs, I am hoping to get a call on Monday (10/1 or right thereafter) to find the next update. I'm kind of glad that the fix is taking place in a BMW manufacturing facility rather than a dealer (nothing against the dealers), but since the SC plant has a bunch of M cars of their own, hopefully they are very well experienced in this fix by the time they work on mine. |

1. Any cars on ships right now that arrive at the port will be held at the port for the recall work to be performed. This is different than what BMW NA told me on Friday when they called. Two reasons why I believe this is good news: (i) the cars (at least at the VPC in NY) will be stored indoors in the VPC warehouse (my CA confirmed this fact), and (ii) it would make sense to me (although this is not a confirmed fact) that the first available batch pumps would go to those locations where there are a concentration of cars that could be repaired quickly. 2. My dealer said they do not get notification when the car clears customs. The only notification they receive is when the car clears the VPC and is "placed on the trucking pad" for pick-up by the trucking company. Once it is "placed on the trucking pad" it must be retrieved by the trucking company within 48 hours. 3. The service manager at my dealership said he was told the replacement pumps for customer vehicles will be available "within two weeks" based on a conversation he had this morning with BMW. Since the Toronto hits port tomorrow and it normally takes a week for cars get to the dealer once off-loaded (i.e., clear customs and the VPC, get loaded on a truck and delivered), then we are hopefully only looking at a week or less delay in the delivery of our cars. 4. My CA was told BMW will cover the cost of a rental car from Enterprise (gee, thanks!). I pointed out that a Nissan Altima or Toyota Corolla is not really an acceptable replacement for an M5. I also advised him that I sent an email to BMW USA about the need to provide a credit on my lease while my M5 is out of service. He's heard nothing about if/how BMW plans to handle compensation. That's all from today's conversation. Will advise when/if I hear any additional details.

I just got off from the phone from BMW NA corporate office regarding the side bolster function missing.
I also asked about the recall on the pump and she confirmed all the EU delivery vehicles as well as other M5s currently on the US bound ships will be held at the port until the pump is replaced there. Although this will delay my car getting to the dealer, I actually prefer BMW doing the repair than the dealer. Mechanics doing this repair will do a better job because they will only be doing this work repeatedly for the next couple weeks and be really good at it. |

Hmm...I heard different. Just got off the phone with BMW NA and they told me the fix will take place at the dealer. They are aware that I am an ED customer.
Emailed my CA to speak with the service manager to see what they have heard. I agree, much rather have this done ASAP at the VPC rather than having the dealer handle the repair. Anyone else have data to backup a VPC vs. dealer fix? |

If there was a definitive process I believe that BMW would have communicated, via bulletin to their dealers, what the process is going to be for the recall. The fact that 48 hours has elapsed, if not more, since the recall went public clearly highlights a fundamental flaw in the brand and the opinions that BMW has of their customers. M5 customers aren't just the average run of the mill customers. I saw Toyota handle their recall issues more effectively than BMW for their $25K cars.

My dealer told me repairs are going to be done at VDC. I'm Ok with that.
So at what time for us ED people will BMW start paying for a rental car?

Unfortunately they only had base 328 or base x3. I took the x3. I have to commend my CA and Service Manager. They are trying to make the best out of very bad situation. It sure looks like BMW is putting their dealers and service teams in the cross hairs of customer anger. |

TORONTO is back on the radar close to the East Coast. Estimated dock time in NY is 9:00am EST, Wednesday. Here is hoping they get our cars off the boat tomorrow and hopefully started through the customs process.
