Just had this same issue...car is at the dealership and my extended warranty company is trying to claim pre-existing condition when I didn't have an issue before the contract waiting period is over...anyone have ideas on how to get recourse?

You might be out of luck. Depending on the fault codes and damage to whatever component failed.
If the clutches are worn, it would be claimed under wear and tear
My clients situation was lucky to only be the small clutches
Other shops have not been so lucky and the fault was internal of the valve body which BMW more then likely will not get approval from Germany to replace

CODE 40FC01: Gearshift rod 5-7: Gear Fault.

That's the code I'm getting... BMW want's to replace the transmission but I was looking at the posts here earlier from SSPKris and I'm wondering if a cleaning of the transmisison parts and software upgrade would fix the issue.

Do we know how many labor hours it takes to clean the transmission?

Would I be off better buying a used one for 2500-3k + labor?

I can provide some insight into this thread at the moment. Currently running SSP Spec R clutch kit with the Cooling Package. I just completed a 3,000 mile road trip with my M5, which I still have the original SSP Clutch discs installed and my Steve Dinan Carbahn built forged motor. I now have about 26,000 miles on my DCT with the SSP kit and about 20,000 miles on my built motor. My M5 has performed nothing short of exemplary. No issues related to the Achilles Heel with my DCT at all. My M5 has been running strong with tons of torque, especially with my Stage V turbos. I think a lot of issues may be due to faulty installs and/or bad luck with clutch discs warping prematurely. But I do have a certain driving style, which may be a factor in why my aftermarket upgraded parts continue to outlast all others. Basically, I never ever ever, mash the throttle from a dig. I understand physics and the kinds of stresses that can be induced with cars that are RWD only and making over 800tq to the crank. Instead I leave the throttle mashing from red lights up to the F90 folks with their intelligent ///M xDrive System and much more reliable ZF8speed Auto Transmission. Instead, I mash the throttle from about 40-60mph quite often. Works like a charm. This much power and torque in my car and it feels like it's launching from a dig, it's incredible. Now if I wanted to do 0-60 and have fun I'd get a Tesla P100D or F90 or E63S, etc, etc... But there's more to the driving experience than 0-60 times, I feel. Like steering wheel feel and a transmission that communicates to you.

Per recommendation of SSP Kris, I brought the car to the dealership and had them do a firmware update of the transmission to the latest (Kris said they did an update in September of 2016).

Car had the Gear Rod 5-7 issue for about another week, and then out of nowhere stopped having issues. I've had about 1500 miles on the car since the update and haven't had any issues yet. Crossing fingers that this problem stays away from my car. My transmission has about 35,000 miles on it.

Did a couple of 4th gear redlines last night actually and so far so good...*knocks on wood*

still not clear to me: seems like early on in the thread BMW Dealership and SSP confirmed that the issue is 90% of the time related to buildup from degradation of hall effect sensors reading incorrectly / flushing and changing of tranny fluid and filters / cleaning of mechatronics and valvebody. Later on schnell1982 confirms that small disks were warped and resolved the issue.

Seems like it can be either of the 2. Could anybody explain how a warped disk could trigger this issue to occur? (from a technical standpoint)

Unhappy M5 F10 Transmission failure

Hi, was your transmission ever fixed, I also get this error now: CODE 40FC01 Gearshift rod 5-7: Gear Fault? While driving and hard accelerate in 5th gear it jumps to neutral, the vehicle refs then, and then only skip to gear 6 and 7. After switching the vehicle off and on again then only the 5th gear is working again. So driving normally there's nothing wrong.

If the trans skips its over lol
It's either clutch or the trans itself.
If I had to give a % mark

30% clutch
70% trans

I went through 3 trans and 7 clutch's lol this is how I know.

I have a pretty high HP setup, trans wise I’m running the SSP Spec X package with cooler, SLG high capacity DCT pan, and billet baskets. I also have a trans flash from XHP. No dyno yet but should be in the realm of 800whp - haven’t had this issue. I have 4K miles on my setup.

Any ground clearance concerns with the seemslegitgarage pan?

I have the same issue i fit a new Dodson clutch in BMW M4 F82 2016 IT 62.500 mile it didn't adaptation first BUT AFTER IT did i drive the car for 155 mile and i start to race my self from first race i get to code

Transmission active codes
40D108 - Reference torque, clutch 1: too
high.
40F301 - Gearshift rod 5-7

The gear first have stock tune

I tray to fix it after i put GTS style tune

And a gain the same problem
I don't know what to do the clutch rated 1400WNM
But the is full bolts on with meth injection jb4

🥲🥲 im crying like little 👧 right know 🥲🥲

Update the company tells me to go to their friends garage how tell me to open that clutch we opened the clutch and all listen (all12 disks was burned 🔥 )heavy burned (like they were burned house and they were in the house ) the company asks that i must send the clutch to them and i send it after 3 months they say it's not the clutch company problem but it's my problem when we but the clutch we didn't make it how enough for adaptation but adaptation when successful but they say i muct heat the gear more and eveyone know that i lost i my mind i don't know how that happened
I lost 10200$ + GEAR have the same issue even after i get the stock clutch now and no one in my country know how to fix it all says get a new gear
now im lost

And be carefully out there from being egos and want the top in everything the clutch is not for sell yet and maybe they will not sell it any more maybe
