What do you do when BMWNA denies a warranty claim? Build the motor!

Log story short, (posted in another thread) I was doing a 3rd gear highway pull and got a drivetrain malfunction light on the dash with a horrible shaking during acceleration. Thought it was because of bad spark plugs, but the dealership ended up saying it was a bent rod and I needed a new motor.

BMWNA denied the warranty claim due to the original owner not having the car serviced at 1,200 miles at a dealership. So, it was either hire lawyers and go after BMWNA or make the motor bullet proof and go for 1k whp. Motor just got yanked late yesterday, breakdown beginning next week. My good friends at MNC Performance in Oceanside, NY will be doing the work! I'll try to keep this post updated with pics as much as possible!

Had about 25k miles on the car. Mods were just Intakes and DP's. Thank you sir!

I believe that's the first photo I've seen of the engine bay with the suspension crossmember still in place. Everyone else has dropped the engine along with that crossmember. Was that easier for them?

Did u even try to lawyer up? I'm all about doing cool stuff, but I've been in your situation before and my lawyer was able to get me a great resolution with BMW paying me money in the end.

So what are you doing to the motor then? Rods? Pistons? Those two alone will set you back at least $7-10k just in parts. I also don't recommend aiming for that much power without lowering the compression and increasing fueling, which will cost even more. When doing an engine build, the costs can add up very quickly. I know. Good luck!

Did you buy the car as CPO,..and was it CPO at time of incident? If it was,..then get a lawyer! You will win!! It doesn't matter if the original owner put the wheels on backwards/upside-down,...the CPO process means that BMW has THOROUGHLY checked the car out for ANY issues,...and that such vehicle MEETS stringent "CPO CERTIFICATION" standards,..tolerances,..wear and tear, you name it!

Case in point,...I bought a '13 M5 from a local dealer,....upon doing a test drive,...I noticed a noise coming from the rearend! It turned out that the transaxle needed to be replaced! Get this,...even though BMW would not "CPO" the car,...the rear axle was replaced under warranty! That said,...the issue about the previous owner is BS! Call their BS,...and GL!

FYI. Should have been covered. No doubt. I bought a ‘14 w/ 29k still under factory warranty. The last owner did not do the 1200 service so no CPO option could be purchased.

Bought the car, drive it home 800 miles and about 20 miles from home engine below. No questions asked by BMWNA. Authorized same day and replaced in 2 weeks. BMWNA also provided me with a check for my inconvenience. I’m happy to share my info and use my situation as an example.

If it was a CPO, wouldn't pulling the motor completely void any warranty it had left? Just a thought, if you decide to still try to fight it.

I did, and most of the lawyers wanted a $20k retainer for this. For that money, I'd rather build it.

The car is at MNC currently in Long Island. The motor will be getting bored out most likely at VAC when its ready. Long road ahead for me

Damn, sorry to hear that man. Let me know if you need any help/advice. Going the built motor route is not an easy undertaking and I have learned a lot from many mistakes made.

Just checked my service history, I had the 1200 service.

But still, I would've argued without a lawyer, I would've just been persistent and file claims with BBB and so on.

They would've caved. Pure BS move on BMWs part.

Whats included in the 1200 service anyway.

Wow.. when I was shopping for my CPO M5 I found one in Seattle that seemed perfect, except it didn't get serviced until mile 7200. They were selling it as CPO, though.

Well, the warranty would require the original owner to follow Mfr's scheduled maintenance requirements, etc. So, essentially, No CPO means that once the warranty ended, BMW was no longer liable for any defects problems that come up,....essentially no matter who owns the car.

Disassembly has begun!

They began disassembling it today. For some strange reason, there was a lot of dirt on the pistons when they opened it up!

What about taking it to another dealer? I know it’s a moot point now. Did the dealer see the mods or did you change it back to stock when you brought it in? Also, isn’t this pretty crazy/anomalous? Aren’t these engines supposed to be pretty bulletproof?
