Sorry Jose! Sucks. Happened to me my very first week of F10 ownership. It will definitely hurt resale, so try the diminished value route. This is my excuse for now buying very bright colored cars

Thanks Rob, Jon and others for the well wishes.
The estimate now is $14k+ and growing depending on whether or not the car has frame damage. I'll know this week. Does anyone know where I can find BMW documentation on what type of force / impact it would take for the headrest to deploy? I looked around but couldn't find anything. I'm sure one of our forum members can readily obtain this information. Thank you.

I just got into an accident, was hit head on by a drunk driver. $33,000 in damages. While trying to fight for Diminished value I'm feeling defenseless as I can not find any Market Value comparisons for a 2013 M5 with Frame damage and Airbags deployed. How can I fight for more DV if there isn't anything to compare against? Any advice would be appreciated.

I ran across this thread today and figured I would throw my .02 in and provide some information that could potentially provide some information to you all on Diminution of Value(DOV) claims.
I am an insurance adjuster for automotive claims and I handle DOV claims on a daily basis. I was previously a liability adjuster and worked that for several years. My job requires me to work DOV claims and asses vehicle damages and repair procedures to make sure the proper thing is being done. I want to first address a comment that was made about the threat of using the Department of Insurance(DOI). I often times have people threaten me with this. What they don't know is that if I am in the right for the state guidelines (proper contact, proper disclosure, etc...) is that I really could care less if you call the DOI. In most cases I provide the number to people and tell them to go ahead. I am not saying that I am right every time, but if you file a claim in January and wont return my calls until December and start demanding an immediate fix, don't expect to jump to the front of the line. Furthermore, if you filed your claim yesterday morning and start calling and causing problems you do not go to the top of my list. On to DOV While most states do provide DOV after accidents (to both first and third party) some do not. The compliance(rules) for that is made by the individual state. Also, just because DOV does exist in that state does not mean it applies to your claim. For example, in Wisconsin has third party DOV, however it only applies if you can prove that after repairs are complete that the repairs did not restore your vehicle to the pre-loss value. That does not mean that your vehicle is worth less now because of a carfax, it has to be because the repairs that were done are crap. If you admit that everything is back to the manufacturer specifications, you don't have a DOV claim in Wisconsin. A few more things to consider in DOV. -The first thing I do when I get a DOV claim is to pull a report in ISO and Accurint. If I find that the vehicle was previously in a wreck, the chances are pretty good that I am not going to pay you anything for DOV. I follow this to the extent that if you hit a mail box and cause $1,000 in 2014, and now in 2015 you had a loss that was 25K in damage, the diminution of value was from the first accident, not the second. If my company is not responsible for the first accident... I am not going to pay your for it. -In DOV claims we are looking at your vehicle compared to the market. If you have a 2005 Ford F150 which has normal wear and tear for a 10 year old vehicle, then get in an accident which requires the replacement of a fender(bolt on part), you do not have a case for DOV. The vehicle is actually in better condition after the repairs are complete than it was prior to the loss. -If the repairs that were done are crap we are actually not going to pay a DOV claim (I know in my example above I said we would), but 1 of 2 things will happen. If you selected the shop to do the repairs- it is on you to have that shop correct their crap work. If we reccomended a shop we will make that shop fix the vehicle correctly. This happens. I assume most of you will not be selling your vehicle private party, but rather trade in at the dealership. The salesman is certainly going to tell you that the vehicle is worth less due to the accident, but when he puts it back on the lot he is not going to advertise it at a reduced price due to the accident. They are still going to sell it full price. We often have claims where someone will go to the collision center owned by the dealership for repairs. Once the repairs are complete they drive it around the lot to trade it in and are told by the sales man, "Well it was in that wreck..." Naturally they call us demanding more money. The first thing I do in this situation is call the collision center at the shop and ask the manager if he knows what the salesmen are saying about the job performed by them. This typically starts a nice fight between the two departments. I could keep going, but I'll wrap this up. If you have a brand new BMW(or any make) and are in an accident, I think you have a strong argument for DOV. It really just depends on your states compliance. When I worked at State Farm you were pretty much only getting DOV if you lived in GA. The company I am with now we will offer it in any state and we feel nothing is set in stone and is negotiable. When a company will not work with you on DOV it may not be because they don't want to, but rather because the state does not provide for it. Complaining to the DOI will not get you anywhere. |
